Terms and Conditions of Sale

Preamble

Purpose

These general terms of sale define the rights and obligations of VMB Diffusion SAS and the Buyer regarding the sale of Products through the Website or Customer Service. Any order constitutes full acceptance of these terms.

Scope

These terms apply to all product sales via the Website and Customer Service for delivery in France, Monaco, and internationally unless otherwise indicated. By ordering, the Buyer confirms having read and accepted these terms.
Orders validated electronically are considered irrevocable acceptance of these terms.
These terms remain valid while online; VMB Diffusion SAS reserves the right to modify them at any time. Changes apply to all subsequent orders.

Order

Buyer Capacity
Only persons legally able to contract for Products may place an order. Buyers must be at least 18 years old or legally authorized in their country. Proof of identity or age may be requested.

Placing an Order
Orders may be placed via the Website or email. Internet costs are borne by the Buyer. A Buyer account is required before the first order. Buyers must provide accurate personal and payment information. Billing address must match the payment method. Before confirmation, the Buyer can review and correct the order. VMB Diffusion SAS is not responsible for input errors; reshipment costs are the Buyer’s responsibility.

Order Confirmation
After order confirmation, an email acknowledging the order and details will be sent. If a product is unavailable, the Buyer may be refunded within 30 days. VMB Diffusion SAS may refuse orders for legitimate reasons (e.g., age, product availability). The order confirms acceptance of product prices and characteristics.

Order Tracking
The Buyer can track the order by contacting Customer Service.

Product Prices

All prices are inclusive of applicable taxes. Delivery outside France and Monaco is via Customer Service and may incur additional charges. Prices are subject to stock availability. VMB Diffusion SAS may modify prices at any time; orders are billed based on the price at confirmation.

Payment Conditions

Payments are in euros or agreed currency. Accepted methods: PayPal (CB, Visa, Mastercard), Credit Card (Up2pay e-Transactions), Klarna 3X/4X, Check (France/Monaco only), Bank Transfer. Payments are final, subject to legal withdrawal rights where applicable.

Delivery

Delivery Location
Delivery is made to the Buyer’s permanent address. Delivery to hotels or P.O. boxes may not be possible. Verification may be requested.

Delivery Time
Delivery occurs after payment. Maximum delivery time: 30 days. Delays allow order cancellation according to local consumer law.

Delivery Method
Products are delivered by selected carrier. Failed deliveries due to Buyer error may result in return.

Product Reception
Buyer must check product condition on receipt. Visible defects must be reported within 48 hours.

Return & Refund

Customized Products (personalized with name, design, or message) cannot be returned except for defects. Non-customized products can be canceled within 24 hours; otherwise, returns are not possible.
Refunds are made to the original payment method. Right of withdrawal applies according to local law (e.g., 14 days for standard products). Transport costs are borne by the Buyer unless defective.

Return Conditions

• Merchandise must be unopened and in original condition
• Must not be worn, washed, or soiled
• Return within 14 days of receipt (postmark as proof)
• Initial and return shipping costs are the Buyer’s responsibility

Complaints

For inquiries or complaints, contact Customer Service with your order number.

Legal Warranties

Products comply with applicable law regarding conformity and hidden defects. Actions for hidden defects must comply with local law.

Electronic Files & Privacy

Personal data is used for order tracking and communication. Buyers can access, correct, or delete data. Cookies may be used to improve service.

Liabilities

Liability is limited to direct and foreseeable damages. Not responsible for misuse, third-party acts, force majeure, linked websites, or internet risks.

Intellectual Property

Website content, trademarks, logos, and designs belong to VMB Diffusion SAS. Reproduction without consent is prohibited. Hyperlinks require authorization.

Force Majeure

Obligations are suspended in case of unforeseeable events (war, riots, strikes, natural disasters). Buyer is informed within 7 days. If suspension exceeds 15 days, the Buyer may cancel the order with refund.

Partial Invalidity

If any clause is illegal or void, remaining provisions remain valid.

Proof Agreement

Electronic or phone communications are valid proof of agreements.

Order Archiving

Orders and invoices are archived digitally according to legal requirements. Durable archiving ensures authenticity.

Disputes & Jurisdiction

French law governs these terms. Only the French version is legally binding. Buyers should seek amicable resolution before litigation. Competent French courts handle disputes, except where local law provides mandatory protection.
